First, we would like to inform you here about your rights as a data subject. These rights are standardized in Art. 15 - 22 EU-DS-GVO. This includes:

Rights of objection

Please note the following in connection with rights of objection:

If we process your personal data for the purpose of direct marketing, you have the right to object to this data processing at any time without giving reasons. This also applies to profiling, insofar as it is related to direct advertising.

If you object to processing for direct advertising purposes, we will no longer process your personal data for these purposes. The objection is free of charge and can be made form-free, if possible to: datenbank@bayern-innovativ.de.

Purposes and legal bases for data processing

When processing your personal data, the provisions of the EU-DS-GVO and all other applicable data protection regulations are observed. Legal bases for data processing arise in particular from Art. 6 EU-DS-GVO. We use your data to initiate business, to fulfill contractual and legal obligations, to implement the contractual relationship, to offer products and services and to strengthen the customer relationship, which may also include analyses for marketing purposes and direct advertising.

The range of services offered by Bayern Innovativ GmbH includes:

  • the implementation of events (congresses/forums, workshops, network/cluster meetings, partnering, matchmaking events)
  • the initiation and support of cooperations (including network design, competence presentation, commissioned projects, working groups, partnering, consortia formation)
  • the support of market access via trade fair joint stands, market intelligence, key contacts
  • the approach to funding
  • the transfer of knowledge about trend reports, technology and market studies, technical reports.

Your consent also represents a permission provision under data protection law. Here we clarify the purposes of data processing and your right of withdrawal. If the consent also refers to the processing of special categories of personal data, we will explicitly point this out to you in the consent.

A processing of special categories of personal data within the meaning of Art. 9 (1) EU-DS-GVO will only be carried out if this is required by legal regulations and there is no reason to assume that your legitimate interest in the exclusion of the processing outweighs.

Transfer to third parties

We will only pass on your data to third parties within the framework of legal regulations or with appropriate consent. Otherwise, we will not disclose your data to third parties unless we are required to do so by mandatory legal provisions (disclosure to external bodies such as supervisory authorities or law enforcement agencies).

Receivers of data / categories of recipients

Within our company, we ensure that only those persons receive your data who need them to fulfill contractual and legal obligations. In many cases, service providers support our specialist departments in the performance of their tasks. The necessary contractual framework under data protection law has been concluded with all service providers. This includes shipping service providers for the dispatch of advertising materials, the payment service paypal, agencies for the creation of advertising and information materials, service providers for Internet hosting, and software providers.

Third country transfer / third country transfer intention

We do not transfer your personal data to any service provider outside the European Economic Area.

Storage period of data

We store your data as long as they are needed for the respective processing purpose. Please note that numerous retention periods require that data continue to be stored (must). This applies in particular to retention obligations under commercial or tax law (e.g. Commercial Code, Fiscal Code, etc.). If there are no further retention obligations, the data will be routinely deleted after the purpose has been achieved.

In addition, we may retain data if you have given us your permission to do so or if legal disputes arise and we use evidence within the framework of statutory limitation periods, which can be up to thirty years; the regular limitation period is three years.

Secure transmission of your data

To best protect the data we store against accidental or intentional manipulation, loss, destruction or access by unauthorized persons, we use appropriate technical and organizational security measures. The security levels are continuously reviewed in cooperation with security experts and adapted to new security standards.

The data exchange from and to our website is always encrypted. As a transmission protocol, we offer HTTPS for our website, in each case using the current encryption protocols. In addition, there is the possibility of using alternative communication channels (e.g. the postal service).

Obligation to provide data

Various personal data are necessary for the establishment, implementation and termination of the debt relationship and the fulfillment of the associated contractual and legal obligations. The same applies to the use of our website and the various functions it provides.

We have summarized details for you in the above point. In certain cases, data must also be collected or made available due to legal requirements. Please note that a processing of your request or the implementation of the underlying debt relationship is not possible without the provision of this data.

Categories, sources and origin of data

Which data we process is determined by the respective context. This depends on whether you use one of our forms or subscribe to our newsletter, for example. Please note that we may also provide information for special processing situations separately in an appropriate place.

When you visit our website, we collect and process the following data:

After 7 days at the latest, anonymization takes place by shortening the IP address so that no reference to the user is made.

Contact form / contacting us by e-mail (Art. 6 para. 1 lit. a, b EU-DS-GVO)

On our website, there is a contact form that can be used for electronic contact. If you write to us via the contact form, we process the data you provide in the contact form to contact you and answer your questions and requests.

Hereby, the principle of data economy and data avoidance is observed by only requiring you to provide the data that we absolutely need to contact you. These are your e-mail address and the message field itself. In addition, your IP address is processed for technical necessity as well as for legal protection. All other data are voluntary fields and can be provided optionally (e.g. to answer their questions more individually).

If you contact us by e-mail, we will process the personal data provided in the e-mail solely for the purpose of processing your request. If you do not use the forms offered to contact us, no further data collection will take place.

Newsletter (Art. 6 para. 1 lit. a EU-DS-GVO)

On our website you can subscribe to a free newsletter. The e-mail address provided during newsletter registration and your name, if provided, will be used for sending the personalized newsletter.

The principle of data economy and data avoidance is observed, as only the fields name, company and e-mail address are marked as mandatory fields. For technical necessity as well as for legal protection, your IP address is also processed when ordering the newsletter. In addition, our newsletter tracking records user behavior for statistical evaluation. If you have consented, we evaluate your clicks in newsletters using so-called tracking pixels, i.e. invisible image files. These are assigned to your e-mail address and are linked to a separate ID in order to clearly assign clicks in the newsletter to you. The usage profile is intended to tailor the newsletter offer to your interests. We record when you read newsletters and which links you click on, and infer an interest profile from this.

You can, of course, unsubscribe at any time using the unsubscribe option provided in the newsletter and thus revoke your consent.

The personal data you provide when subscribing will be stored in the Salesforce Sales Cloud. In addition, your personal data will also be transferred to the Salesforce Marketing Cloud in order to carry out personalized advertising measures by means of e-mail. The processing will take place until you revoke your consent. The data will be used exclusively by us.

Chat (Art. 6 para. 1 lit. a EU-DS-GVO)

On our website there is the possibility to contact us via a chat form.

Hereby the principle of data economy and data avoidance is observed, in that you only have to provide the data that we absolutely need for an exchange of conversation with you. This includes your name, company and e-mail address. In addition, due to technical necessity as well as for legal protection, your IP address as well as the Bayern Innovativ entry URL, Bayern Innovativ chat URL, chat history, browser information, the operating system used and the number of visits are processed.

To best protect the security and confidentiality of your data, we implement appropriate security measures. Your request is transmitted to us in encrypted form.

In the context of the chat function, we work with the tool Userlike of the provider Userlike UG Probsteigasse 44-46, 50670 Cologne, Germany.

Order Innovation Magazine (Art. 6 para. 1 lit. b EU-DS-GVO)

We process the data you provide in the context of the order form for our Innovation Magazine only for the purpose of carrying out or processing the shipment.

The principle of data economy and data avoidance is observed in that you only have to provide us with the data that we absolutely need for the execution of the contract or for the fulfillment of our contractual obligations or to whose collection we are legally obligated. Of course, you can also provide more data of your own accord if you wish to do so.

Pardot Marketing Automation System ("Pardot MAS")

We use the Pardot Marketing Automation System ("Pardot MAS"), a special software for recording and evaluating the use of a website by website visitors and for sending newsletters. When you visit our content on www.go.bayern-innovativ.de, Pardot MAS records your click path and uses it to create an individual usage profile using a pseudonym. For this purpose, cookies are used that allow your browser to be recognized. However, you can deactivate the creation of pseudonymized usage profiles at any time by configuring your Internet browser so that cookies from the domain "pardot.com" are not accepted. However, this may lead to certain restrictions in the functions and user-friendliness of our offer. Microsoft Bookings

In the context of appointments with the Bavarian Project Management Agency, the Microsoft Bookings service (service of Microsoft Office 365) of the provider Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18 D18 P521 (hereinafter: "Microsoft") is used for online appointment scheduling. Through this software, an electronic calendar software, you can book an appointment with our staff. We offer this service both if you are already a customer and if you are interested in our services without already having a contractual relationship with us (contract initiation).

A connection to Microsoft Bookings is only established if you receive a link through an email and call up the appointment booking function. For the appointment booking, your entries in the appointment booking form are transferred to Microsoft. The legal basis for the processing of your data in relation to Microsoft Bookings is Art. 6 I 1 b DSGVO (data processing in connection with the initiation or performance of a contract).

In order to make an appointment reservation, it is necessary for you to provide your name, as well as an e-mail address at which we can contact you. In addition, a funding code may be requested in order to be able to guarantee an assignment. Furthermore, you can voluntarily provide additional information. Please note that we cannot offer you an appointment if you do not provide the mandatory information or do not provide it completely. However, you are not obligated to use Microsoft Bookings to make an appointment. If you do not wish to use the service, we will be happy to assist you around your request via the aforementioned alternative contact channels.

Your data with regard to the use of the appointment booking option via Microsoft Bookings will not be transferred by us to third countries outside the EU or the European Economic Area. To the best of our knowledge, which is based on the information available from Microsoft, the data is also not transferred by Microsoft to third countries. We have concluded the necessary data protection agreements with Microsoft.

Your data will not be processed by us for longer than is necessary in relation to the triggered appointment request/reservation. Please take into account that, if applicable, supplementary storage/deletion periods may apply, insofar as we are subject to such.

CovPassCheck App (checking "G status")

For the purpose of checking vaccination status, convalescent status or test status in connection with Covid-19, we use the CovPassCheck App of the Robert Koch Institute (RKI, Nordufer 20, 13353 Berlin, Germany). To the extent required by law, the app is used to check the so-called "G status" at events and admission controls. Depending on the applicable regulations, vaccination status, convalescent status and/or test status may be processed. The legal basis for the data processing of the "G status" is Art. 9 para. 2 lit. g EU-DS-GVO in conjunction with § 3 para. 2, 1 p. 2 BayIfSMV.

In addition, the personal details (first name(s), surname(s) and date of birth) are also displayed as part of the check for the purpose of random identity checks. In this way, the identity is ensured by means of matching the identification documents. The legal basis for this processing and the random control of identity documents is Art. 6 para. 1 p. 1 lit. c EU-DS-GVO in conjunction with § 3 para. 2, 1 p. 2 BayIfSMV.

We are legally obliged to process the data.

The data are stored by means of QR code (CBOR WebToken) on the terminal device of the persons to be checked and are not stored by us in the CovPassCheck app, but only displayed via a status message (green or red) and display of personal data, as well as validity period (Corona test). The verification, i.e. the comparison of the digital signature, is carried out via systems of UBIRCH and without data with personal reference.

Further information stored in the certificate or QR code, such as information about the vaccine, the vaccine dose, pathogen, manufacturer, etc., is not displayed in the CovPassCheck App.

Advertising purposes existing customers (Art. 6 para. 1 lit. f EU-DS-GVO)

Bayern Innovativ GmbH is interested in maintaining the customer relationship with you and in sending you information and offers about our products / services, e.g. upcoming congresses, cooperation forums, joint stands or other events. Therefore, we process your data to send you relevant information and offers by e-mail.

If you do not wish this, you can object at any time to the use of your personal data for the purpose of direct marketing; this also applies to profiling, insofar as it is related to direct marketing. If you object, we will no longer process your data for this purpose.

Cloudfront (Art. 6 para. 1 lit. f EU-DS-GVO)

This website uses the content delivery network (CDN) Cloudfront. This is a service of Amazon Web Services Inc, 410 Terry Avenue North, Seattle, WA 98109-5210. The Cloudfront CDN provides duplicates of data of a website on different Amazon Web Services (AWS) servers distributed worldwide. This provides faster website load times, increased resiliency, and increased protection against data loss. Some of the images and videos embedded on this website are retrieved from Cloudfront CDN when the page is accessed. Through this retrieval, information about your use of our website (such as your IP address) is transmitted to Amazon's servers in other EU countries and stored there. Creation of user profiles or use of cookies that are not purely functional (Art. 6 para. 1 lit. a EU-DS-GVO)

Matomo (Art. 6 para. 1 lit. a EU-DS-GVO)

On our website, provided that you have given your consent (Art. 6 para. 1 lit. a EU-DS-GVO), we use the service "Matomo" (formerly "Piwik"), an open source web analytics service provided by InnoCraft Ltd, 150 Willis St, 6011 Wellington, New Zealand. Matomo stores cookies on your terminal device that enable an analysis of your use of our website. The use of Matomo enables us to analyze the use of our website, as well as individual functions and offers, and thus to continuously improve the user experience. For data protection reasons, all data collected in this process is stored locally only:

  • two bytes of the IP address of the calling system of the user
  • the called website
  • the website from which the user has reached the called website (referrer)
  • the subpages, which are called from the called website
  • the time spent on the website
  • the frequency of calling the website

We use Matomo with the setting "Anonymize Visitors' IP addresses". This means that IP addresses are further processed in an abbreviated form, thus excluding any direct reference to individuals. The software is set so that the IP addresses are not stored in full, but 2 bytes of the IP address are masked. In this way, an assignment of the shortened IP address to the calling computer is no longer possible. The IP address transmitted by your browser by means of Matomo is not merged with other data collected by us.

You can revoke your consent to the use of Matomo at any time in our cookie settings.

Podigee (Art. 6 para. 1 lit. f EU-DS-GVO)

We use the podcast hosting service Podigee of the provider Podigee GmbH, Schlesische Straße 20, 10997 Berlin, Germany. The podcasts are thereby loaded by Podigee or transmitted via Podigee.

The use is based on our legitimate interests, i.e. interest in a safe and efficient provision, analysis as well as optimization of our podcast offer according to Art. 6 para. 1 lit. f. DSGVO.

Podigee processes IP addresses and device information to enable podcast downloads/playbacks and to determine statistical data, such as call-up figures. This data is anonymized or pseudonymized before being stored in Podigee's database, unless you are required to provide the podcasts.

All Podigee content is disabled by default. A direct connection to the Podigee servers is only established if you consent to the use of Podigee within the cookie settings or activate it independently with a click.

Google Maps (Art. 6 para. 1 lit. a EU-DS-GVO)

On our website we use Google Maps (API) from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). To ensure data protection, Google Maps is disabled when you first enter this website. A direct connection to Google's servers is only established when you independently activate Google Maps (consent according to Art. 6 para. 1 p. 1 lit. a DSGVO). You can revoke your consent at any time in the cookie banner (fingerprint icon). This prevents your data from being transferred to Google the first time you enter the site. After activation, Google Maps will store your IP address. This is then usually transferred to a Google server in the USA and stored there.

A third-country transfer takes place in the process, so that in this case there is a risk that your data may be processed by US authorities for control and monitoring purposes, without you possibly having any legal remedies. However, we take the possible measures necessary under data protection law in accordance with Art. 44 et seq. EU-DS-GVO to establish the level of data protection in the third country.

All Google Maps content is disabled by default. A direct connection to Google servers is only established if you consent to the use of Google Maps in the cookie settings or activate it yourself with a click.

YouTube (Art. 6 para. 1 lit. a EU-DS-GVO)

We use on our pages the video portal YouTube, which is operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter "YouTube").

All YouTube content is disabled by default. A direct connection to the YouTube servers is only established if you consent to the use of YouTube in the cookie settings or activate videos independently with a click.

The legal basis for the processing of your data is then your consent in accordance with Art. 6 (1) lit. a EU-DS-GVO, which you can revoke at any time by changing the cookie settings with effect for the future. Please note, however, that it will then no longer be possible for you to use the video portal and associated actions, such as participation in an event via livestream.

Please note that in doing so, your IP address and browser data will be transmitted to YouTube and, cookies may be set in your browser. These are then usually transferred to a server in the USA and stored there.

For you, there is the possibility to give your consent for the retrieval of individual videos at any time again.

Please note that a data transfer to a third country outside the EU / EEA can not be excluded, which may have a lower level of data protection than that of the EU. Vimeo (Art. 6 para. 1 lit. a EU-DS-GVO)

In addition to YouTube, we have also integrated videos from the Vimeo platform in certain areas of our website. Here, too, a data transmission to the Vimeo server takes place. These processing operations take place on the basis of your consent (Art. 6 para. 1 lit. a EU-DS-GVO). You can revoke this consent at any time in the cookie settings.

Please note that your IP address is transmitted to Vimeo (Vimeo, LLC555 West 18th Street New York, NY 10011 United States) and that the provider sets cookies in your browser. Social media links

On our website you will find links to the social media services of Facebook, Twitter, Linked In, Xing. You can recognize links to the websites of the social media services by the respective company logo. If you follow these links, you will reach Bayern Innovativ's corporate presence on the respective social media service.
